These terms and conditions (“Terms”) govern your use of the digital marketing services provided by ProsperGroups, based in Oman (“the Agency”). By accessing or using any of the services provided by the Agency, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

1. Services 

The Agency offers digital marketing services including but not limited to Search Engine Optimization (SEO), content marketing, and social media marketing.

2. Client Obligations

Clients agree to provide all necessary information and materials required for the provision of services by the Agency in a timely manner. Clients are responsible for ensuring the accuracy and legality of all content provided to the Agency.

3. GDPR Compliance

The Agency is fully compliant with the General Data Protection Regulation (GDPR) and will handle client data in accordance with GDPR requirements. Clients acknowledge and agree to the Agency’s privacy policy.

4. Fees and Payment

Clients agree to pay the Agency the fees as outlined in the agreed-upon contract or proposal. Payment terms will be specified in the contract or proposal and must be adhered to by the client. We may use third-party payment gateways and clients are obliged to abide by the terms and conditions of those third-party providers when making payements.

5. Intellectual Property

All intellectual property rights in materials created by the Agency as part of the services provided shall remain the property of the Agency unless otherwise agreed upon in writing.

6. Confidentiality

The Agency agrees to keep confidential all information provided by the client, including but not limited to business plans, strategies, and financial information.

7. Limitation of Liability

The Agency shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of its services.

8. Termination

Either party may terminate the agreement with written notice if the other party breaches any material provision of these Terms and fails to remedy such breach within a reasonable time period. All the terminations and obligations are determined and agreed upon in service contracts between both parties. 

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Oman, and both parties submit to the exclusive jurisdiction of the courts of the Sultanate of Oman.

10. Amendments

The Agency reserves the right to amend these Terms at any time. Any amendments will be effective immediately upon posting on the Agency’s website. The clients will be notified of the changes via the email address provided to the Agency in the service contract.

11. Entire Agreement

These Terms constitute the entire agreement between the parties and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter herein.

By using the services provided by the Agency, clients acknowledge that they have read, understood, and agree to be bound by these Terms and Conditions.
